§ 14-300. Unsafe buildings.

  • All unsafe buildings or structures are hereby declared to be illegal and shall be abated by securing, repair, removal, or demolition of same in accordance with the procedures set forth in this code. As an alternative, the building official, or other employee or official of this jurisdiction as designated by the governing body, may institute any other appropriate action to prevent, restrain, correct or abate the violation.

    (1)

    Any building or structure which is unsafe, unsanitary, unfit for human habitation, not provided with adequate egress, or which constitutes a fire hazard, is otherwise dangerous to human life or which constitutes a hazard to the safety, health or welfare of the public, by reason of inadequate maintenance, dilapidation, obsolescence, or abandonment, is considered an unsafe building.

    (2)

    Any building regardless of structural condition, which is unoccupied by its owner, lessee, or other invitee and is unsecured or inadequately secured from unauthorized entry to the extent that such could be entered or used by uninvited persons as a place of harborage or could be entered or used by children or otherwise constitute a danger to the public is considered an unsafe building.
